Orana Mall recognises that Environmental Tobacco Smoke (ETS) is hazardous to health and that non-smokers should be protected from exposure to tobacco smoke. Accordingly, Orana Mall has developed the following policy to ensure protection of the health and safety of those who work at and visit Orana Mall.

Considerations for the changes also reflect a range of legislation protecting customers, staff, retailers and their employees from the effects of Passive Smoking including:

  • Occupational Health & Safety Act 1997 (NSW); (Work Health and Safety (WHS) Act, on 1 January 2012.

  • Workers Compensation Act NSW 1987.

  • Consideration of Common Law obligations for employees and visitors.


Smoking Bans
Tobacco Legislation Amendment Act 2012

The Tobacco Legislation Amendment Act 2012 was passed by the NSW Parliament on 15 August 2012 The Act amends the Smoke-free Environment Act 2000 to make the following public outdoor places smoke-free areas from 7 January 2013:

  • Within 10 metres of children’s play equipment,

  • Swimming pool complexes,

  • Spectator areas of sports grounds or other recreational areas while organised sporting events are being held,

  • Railway platforms, light rail stations and ferry wharves,

  • Bus stops, light rail stops and taxi ranks,

  • Within 4 metres of a pedestrian access point to a public building, and from 2015 in
  • Commercial outdoor dining areas being:
    • a seated dining area, or
    • within 4 metres of a seated dining area on premises that are licensed premises under theLiquor Act 2007 or the premises of a restaurant defined in that Act, or
    • within 10 metres of a place at a food fair where food is sold or supplied for consumption at the event, with a food fair being an organised event at which the principal activities are the sale or supply of food for consumption at the event and the consumption of that food. 
       

Compliance
The Orana Mall Smoke Free Policy must be adhered to at all times. Exceptions will not be granted. Non-compliance will result in the individual:

  • Being asked by the Centre Management or a representative of Centre Management to cease breaching the policy and being told of the Orana Mall smoke free policy

  • Being warned by the Centre Management or a representative of Centre Management and being issued a letter for continual breaches of the policy

  • Being asked to leave the centre by the Centre Management if the breach is continued after a warning has been issued.

 

Why is a designated smoking area being created?
Orana Mall will provide the Designated Smoking Area for customers, lessees and their staff. Whilst there is no legal obligation to provide such an area, Orana Mall recognised that the decision to smoke is a personal choice. The Designated Smoking Areas will be located outdoors, one being  at the rear east end  parallel to Windsor Parade, the other at the front west end parallel to Wheelers Lane.
